Betting Companies Operating From Malta

In February, 2000, a Legal Notice was issued [Legal Notice 34 of 2000 (Operation of Betting Offices Regulations, 2000)] amending the Public Lotto Ordinance to enable International Betting Offices to be set up in Malta to conduct betting transactions by electronic means (whether over the internet or using other electronic means such as telephone, fax, computer or any other means approved by the Gaming Board) to people residing outside Malta.

This has encouraged International Names to reallocate their existing business and entrepreneurs to start their new ventures on the Maltese Islands. Presently over twenty five companies have been granted a licence to operate as Betting Companies.

Betting / Call Centre Operation

Today, a Betting Company can establish a call centre to receive bets together with a processing operation and still benefit from the ITC corporate vehicle, however, the Gaming Board will subject it to a licence. Betting against computer-generated games such as cybercasinos on the internet is not allowed but the internet may be used as a communication medium (email) to the call centre.

The licence fee payable to the gaming board is 0.5% on turnover. This makes our jurisdiction one of the most attractive destinations for setting up offshore internet betting companies. It is good to note that the Malta Gaming Board is after reputable promoters of good standing. Back Office / Processing Operation

Alternatively, operators can establish processing operations with back office activities and while no licence is required the company can still benefit from the ITC corporate vehicle provided the contract for the bet is not carried out in Malta and the betting company is licenced outside Malta. However, Betting Companies not requiring a license will be asked to make a voluntary contribution to the arts or to a charity institution of their choice, the amount of such contribution being left entirely to their discretion. Advantages and Fiscal Benefits

Betting tax is 0.5% of turnover (i.e. the value of all bets received and accepted by the betting company at its betting office).

International Trading Companies (ITCs) are liable to the normal corporate tax of 35% levied on all Maltese companies based upon their chargeable income for the year of assessment. The advantage for non-residents arises at shareholders level. Upon a distribution of dividends by an ITC to its non-resident shareholders, certain fiscal incentives and tax refunds will apply to the non-resident shareholders with the effective tax rate working out to 4.17%. New licensing regime for online gaming by the Malta Lotteries & Gaming Authority


Over the past years Malta has successfully established itself as a serious, well-regulated European jurisdiction attracting on-line betting companies.

The Government of Malta carried out a complete revision and consolidation of the gaming legislation, and a new all-encompassing gaming law was enacted by the Maltese Parliament in virtue of which the Malta Lotteries and Gaming Authority has been set up.

The Malta Lotteries and Gaming Authority has revised the regulations whereby other Gaming activities including online casinos, casino-style games, betting exchanges and lotteries could be allowed after an application is submitted and a license is granted.

The Remote Gaming Regulations 2004 now offers 4 classes of Remote Gaming Licenses; Class 1 Remote Gaming License shall be a remote gaming license, Class 2 Remote Gaming License shall be a remote betting office license or a remote betting exchange office license, Class 3 Remote Gaming License shall be a license to promote or abet gaming from Malta and Class 4 Remote Gaming License shall be a license to host and manage remote gaming operators, excluding the licensee himself.

Once an application for a license is submitted and obligations are fulfilled, a Malta company is incorporated and a license is issued in the name of the Malta Company, better known as a Malta International Trading Company (ITC). The unique feature of the Malta Company is its "onshore" status and once the shareholders are non-resident, very interesting tax benefits apply.
